Poland: change to document certification rules

From 1 January 2010, notaries public no longer have the exclusive right to certify documents as true copies in court, administrative and tax proceedings.

The change may enable cost-savings to be made in proceedings where many source documents are filed with the court or public authority. While the right was limited to notaries public, certification costs were approx. PLN 6 per page.

The right is now also available to advocates and legal advisors in all court administrative and tax proceedings in which they act as attorneys. To a limited extent, this right is also granted to tax advisors and patent agents.

The change does not apply to proceedings pending before 1 January 2010 until after the first instance proceedings have ended.
